Terms of Use

By downloading, installing, or using SwingAI (“App” or “Service”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use SwingAI.

These Terms constitute a legally binding agreement between you and Marcio Meio (CPF: 071.591.707-96), operating as SwingAI, Rio de Janeiro, Brazil.

You must be at least 13 years of age to create an account. If you are under 18, a parent or legal guardian must review and consent to these Terms before you use the Service or submit any video for analysis.

SwingAI is an AI-powered mobile application that analyses tennis technique using computer vision, 3D pose estimation, and large language model coaching. The Service includes:

• Video upload and in-app recording for tennis shot analysis (serve and forehand in v1)
• Automated biomechanical metric extraction and scoring (0–100 per metric)
• AI-generated coaching tips, drill recommendations, and improvement cues
• Progress tracking over sessions
• Annotated slow-motion video replay with skeleton overlay

You agree to:

• Provide accurate, current, and complete information during registration
• Keep your password and Apple Sign In credentials secure and confidential
• Notify us at hello@swingaitennis.com immediately if you suspect unauthorised access
• Accept responsibility for all activity that occurs under your account
• Not create more than one account per person or share your account with others

5.1 Subscription Tiers

5.2 Billing

All payments are processed through Apple's in-app purchase system (App Store). Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date. Apple charges your payment method on file at renewal. Prices are in USD; local taxes may apply.

5.3 Cancellation & Refunds

Cancel via iPhone Settings → Your Name → Subscriptions → SwingAI. Cancelling stops future renewal; you retain access until the end of the current billing period. We do not issue prorated refunds for mid-period cancellations. Refund requests must be submitted to Apple at reportaproblem.apple.com.

5.4 Price Changes

We will give at least 30 days' notice of any price change. Changes apply at your next renewal period. Continued subscription after a price change constitutes acceptance.

6.1 Ownership

You retain full ownership of all videos you upload to SwingAI. Nothing in these Terms transfers ownership of your content to us.

6.2 Licence to Us

By uploading a video, you grant SwingAI a limited, non-exclusive, non-transferable, revocable licence to process your content solely to provide the analysis Service to you. This licence expires when your video is deleted (within 24 hours by default). We will never use your content to train AI models, sell to third parties, or for any purpose beyond delivering your analysis results.

6.3 Our Intellectual Property

The SwingAI app, design, algorithms, scoring systems, and associated software are owned by SwingAI and protected by copyright, trade secret, and other IP laws. You may not copy, modify, distribute, or reverse-engineer SwingAI without prior written permission.

You agree NOT to:

• Upload videos in which other identifiable individuals appear without their consent
• Upload content that is violent, sexually explicit, or illegal
• Circumvent the subscription paywall (e.g., through multiple free accounts)
• Reverse-engineer, decompile, or extract SwingAI's source code
• Use automated tools (bots, scrapers) to interact with the Service
• Attempt to access other users' data or accounts
• Overload our servers with disproportionate API requests
• Misrepresent SwingAI's analysis as output from a certified professional coaching service

We reserve the right to suspend or terminate your account for violations, without prior notice in serious cases.

The Service is provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, SwingAI disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• Analysis results will be 100% accurate or free from error
• The Service will be available at all times or uninterrupted
• Following coaching recommendations will improve performance or prevent injury
• AI-generated coaching tips are equivalent to those of a certified professional coach

To the maximum extent permitted by law, SwingAI's total liability shall not exceed the greater of (a) the amount you paid to SwingAI in the 12 months preceding the claim or (b) USD $50. In no event shall SwingAI be liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms excludes liability that cannot be excluded under Brazilian consumer law (Código de Defesa do Consumidor).

By you: Delete your account via Settings → Delete Account or email hello@swingaitennis.com. Data is scheduled for deletion within 30 days.

By us: We may suspend or terminate your account for breach of these Terms or legal requirements. In non-emergency situations, we will give 14 days' notice and an opportunity to export your data.

Sections 6, 8, 9, and 11 survive termination.

These Terms are governed by the laws of Brazil, including LGPD, Código de Defesa do Consumidor (CDC), and Lei nº 10.406/2002 (Código Civil). Disputes shall first be attempted through direct negotiation via email. Unresolved disputes are submitted to the courts of Rio de Janeiro, Brazil, which shall have exclusive jurisdiction. EU consumers may also use ec.europa.eu/odr.

SwingAI relies on Apple App Store, Supabase, RevenueCat, Anthropic, and Cloudflare. Your use of these services is governed by their respective terms. SwingAI is distributed via the Apple App Store and subject to Apple's Standard EULA (apple.com/legal/internet-services/itunes/dev/stdeula/), incorporated herein by reference. Apple is not a party to these Terms.

We will notify you of material changes via in-app notification and email at least 30 days before the new Terms take effect. Continued use after that date constitutes acceptance.
